Adoption

Mediation, an alternative dispute resolution tool, is a process whereby a neutral third party, the “mediator,” who is often a family law litigator, meets with the parties and their respective attorneys, and assists them in reaching a settlement of their case.  The resolution of the case is in the parties’ hands, and the mediator does not and cannot make any decisions for the parties, nor provide them legal advice. 

Mediation is a unique opportunity for the parties in litigation to take the decision process out of the Court’s hands, and to agree to resolution of their case. If an agreement is reached, the case is finalized, and no appeal may be taken.

Mediation is increasingly being used as a more humane, effective and far less antagonistic way to resolve outstanding issues in a divorce.  In Florida, the Court requires that parties attend mediation prior to seeking judicial intervention.  When both parties are represented by counsel, and even when the parties represent themselves, mediation usually leads to an amicable settlement.
