What is Mediation?

Mediation is a confidential process where a neutral third party helps you and your spouse negotiate a resolution of your family law issues. 

Do I have to attend mediation?

Yes.  In Florida, you must attempt to resolve your family law issues at mediation prior to seeking judicial intervention.

What issues can I resolve at mediation?

You and your spouse can enter into a Mediated Settlement Agreement that resolves your divorce, children's issues, such as a parenting plan, a timesharing arrangement and child support, equitable distribution, spousal support and any other marital or family law matter.

Do I have to sit in a room with my spouse?

No.  You and your spouse are usually in separate rooms with your respective lawyers and the mediator will move between the rooms.

Will my comments during the mediation be held against me in court?

No.  The entire mediation is confidential.  The discussions are in the nature of settlement negotiations and are therefore inadmissible in court.
